TERMS & CONDITIONS

This is an offer to enter into a contract with ​Inspired Focus Coaching (the “Company”) for your participation in ​the service you have purchased.  You, The Client agrees that you have entered into a legally binding contract with the Company. By making your purchase, you agree that your participation in the Program outlined at purchase will be governed by the following terms and conditions.

Confidentiality

The Company and the Client mutually recognize that they may discuss private information. The Company agrees to keep and maintain such information confidential and not to disclose or use such information without the Client’s written or verbal consent. In order to honor and protect the Company’s intellectual property, the Client likewise agrees not to disclose or communicate information about the Company’s Program or Practice, materials or methods to any third parties. The Client acknowledges and agrees that in the course of the services the Company may ask the Client questions which may be challenging or even sometimes disturbing. The Client waives and releases any claims arising or resulting from the Company’s questions, actions or services except for the Company’s breach of their obligations of confidentiality.

Financial Responsibility

We have made every effort to accurately represent the Program and its potential. The testimonials and examples used are not intended to represent or guarantee that anyone will achieve the same or similar results. By signing below, you acknowledge that as with any business endeavor, there is an inherent risk of loss of capital, and there is no guarantee that you will earn any money as a result of your participation in the Program. By signing below, you also acknowledge that you have represented to the Company that payment of the Program fee will not place a significant financial burden on you or your family and that any decisions or actions you take in response to advice or information acquired in the program, and heir consequences, are your sole responsibility.

Authorization of Payment

The investment for the Program, timeframe and term are outlined in the program details at purchase. Payment plan payments will be charged automatically each month on the date of purchase or monthly on the 5th of the month. You acknowledge that your entire fee, whether paid in monthly installments or paid in full, must be paid and that no refunds are issued. By signing below, you acknowledge that you are making a commitment to pay the entire fee to the Company in exchange for participating in the Program, and you further agree to make all payments when they are due.

Disclaimer

The Company is not a psychotherapist or physician and is not trained in diagnosing psychological or medical conditions. If any issues come up for the Client that should be handled by a licensed therapist or physician, the Company will insist that the Client must attend to your health by contacting the appropriate professional. The Company will bring attentive listening, understanding, belief in you and commitment to your success. The Client can expect the Company to challenge you, offer fresh perspectives, make requests (including assigning homework), acknowledge your wins and guarantee utmost confidentiality. Success depends upon the actions taken by the Client to follow the plan and strategies outlined by the Company.

Contact

Client may use email or assigned app such as Voxer or WhatsApp to communicate with Company.   The company will make every responsible effort to reply to communication in a reasonable amount of time during working hours on week days.

Call Procedure, Reschedules and Cancelation

1:1 calls will be set at a recurring time according to the call frequency outlined in the program details.Cancellations or rescheduling a call, by either party, should be made 24 hours in advance. If something urgent arises, either party can reschedule with less than 24 hours’ notice. The Company will make reasonable efforts to reschedule sessions that are cancelled by company in a timely manner. Should Client cancel a call, it will be their responsibility to reschedule within the same month of the cancelled call unless otherwise agreed to. If the Client does not show up for a scheduled call, for any reason, and provides no notice, the Client will not be able to reschedule that session. In the event Company requires extended leave longer than 2 weeks, company will ensure client receives equivalent support during such time by an equally or more qualified coach. Program FeesFees are payable in accordance with the payment schedule set forth above and will be paid via automatic subscription. Failed payments not rectified within five days from the due date will incur a late fee of $75.  Payments may be made by credit card via stripe invoices. A fee equal to any fees incurred by the Coach will be applied to the Client’s bill if a check does not clear or if a chargeback occurs.  The first session will begin after the agreement is signed and payment is received. 

No refunds will be issued once the coaching sessions commence. 

Retreat Payments, Changes and Cancellations

When included in the purchase, Client and Company understands and acknowledges this agreement includes a payment or payment plan towards a Flourish Retreat. Due to the nature of the retreats and because we have obligations to pay the resort to secure your room, all deposits and payments are non-refundable. Should the need to cancel arise, you may transfer your registration and the amount paid to another participant, in an agreement separate from the Company. Company retains the right to accept or decline the exchange participant. It will be your responsibility any and all remaining funds owed are paid. Company has the right to change any component of the event or retreat including but not limited to dates or location. In the case the Company is required to cancel the event, client will receive a full refund.All sales are final.Termination Company may terminate this Agreement before completion of the term of the contract detailed above, on written notice to Client, if any of the following occurs:

The Client fails to perform or observe any of the terms of this Agreement and fails to remedy a breach within 7 calendar days of written notice provided by the Coach concerning the failure; orThe Client cancels more than 3 sessions during the coaching period; orThe Client fails to pay in advance or on the day of the session and subsequently fails to pay within 7 calendar days of the reminder notice date for that session.

 The Client may terminate this agreement, on written notice to Coach, where the Coach fails to perform or observe any of the terms of this Agreement and fails to remedy a breach within 14 calendar days of notice prepared by client concerning the failure. If this Agreement is validly terminated prior to the end of the coaching period, then the Client must immediately pay the Company the balance (if any) of the outstanding fees for the unexpired period of coaching, together with any other money owed by the Client under this Agreement. Upon termination, the Company will immediately cease to be liable to the Client in respect of the coaching and the sessions.

Force Majeure

An unexpected event such as a war, crime, pandemic or an earthquake which prevents someone from doing something that is written in a legal agreement. Company is not liable under these circumstances for non-performance caused by events or conditions beyond Company’s control. This provision does not relieve the Client of its obligation to fulfill payment obligation.

Entire Agreement 

This Agreement and the Terms and Conditions constitute the entire agreement between the parties. If any dispute should arise from this Agreement save as to the payment of the Coach is remuneration, it will be addressed first via mediation. Where mediation is unsuccessful, resolution will be found via court proceedings in the State of Colorado.

Participant Agreement

By completing the purchase process, Client agrees through their authorization, that she/he agrees to the terms of this Program Agreement and the Terms and Conditions. Client understands and agrees to payment terms.
